I had a ch. 7 discharged in Aug of 2002.. I have an irregular income right now, with an unemployment claim. I have no securities, no house, etc..just an old car. We received official documentation of the credit inquiry and citations for the denial, but I just read something online that concerns me: The denial documents mark a delinquency on my part for a student loan that I defaulted on for more than 90 days back in 2009. By 2010, my situation had improved and without any fuss, the DOE began to apply my prompt payments to my balance and it has been that way ever since. I will try to keep this short: Moved out early from an apartment in 2009, did not know there was a fee for early termination. Three years later it shows up on my credit score. This may be a little confusing but I am desperate for help here. Before my husband and I were married he bought a house. We are currently looking at filing bankruptcy and in going through paperwork I seem to have found something odd. In his original loan paperwork it showed 32,000 in a savings and 36,000 in a 401k that he hadnt yet cashed in. He then used 24,000 of the savings money as a down payment on the house. In 2005 his taxes show he owed the IRS 8000.00 from cashing in his 401k in 2004 but the loan which said he still had the 36,000 in 401k in 2005. There is no record of where the 401k money went and he strangely says he cannot remember. First of all, there is no way someone forgets what they do with 36,000 right? Located in Atlanta Georgia I did a self-filing in April of ’09, missed a credit counseling class, eventually missed the deadline to get everything in, and finally, the case was dismissed. The courts here in GA granted me a motion to re-open the case, and I did do that. I’ve paid all the fees as well as I”ve taken the credit counseling class that I missed, per their request. I do recall that the trustee who was handling my case during my court hearing, informed me back in ’09 that I’d made some minor errors on the forms when I filed. The trustee also said that since the errors were minor, the judge may or may not look over them. It was a 50/50 chance. However, those errors were never corrected, because as I’ve stated, the case was dismissed. Meanwhile, now that I’ve taken the required course and paid the required court fees on today, the court clerk informed me that now, the judge will either sign off on it (approve it) or dismiss it (deny it). The court clerk also informed me that the judge’s decision will only take a few days. My question is, what could possibly deny me now, now that everything is in?"
